GENERAL TERMS AND CONDITIONS
for the purchase of tickets for kreativ freiburg 2024
I. Scope, General
These General Terms and Conditions (hereinafter referred to as T&Cs) apply to the ordering of admission tickets online (hereinafter referred to as online tickets) as access authorization to kreativ freiburg in Freiburg. These T&Cs apply equally to consumers and businesses. For the purposes of these T&Cs, a business owner is a natural or legal person or a partnership with legal capacity that, when concluding the contract, is acting in the exercise of its commercial or independent professional activity (Section 14 of the German Civil Code).
II. Contracting Parties
The customer’s contractual partner for the purchase of online tickets is drehpunkt GmbH, Breisgauer Str. 66k, 79110 Freiburg (hereinafter referred to as drehpunkt), unless otherwise stated in the product description.
III. Conclusion of Contract
The offers made by drehpunkt on the order pages are non-binding. By clicking on a selection field at the end of the item description on the item selection page, the items are automatically placed in the virtual shopping cart. The customer can view the contents of the compiled shopping cart at any time by clicking on the „Shopping Cart“ link. The products listed there can be individually removed from the shopping cart by clicking the „Empty shopping cart“ button. Any input errors can be identified on a final review page before the order is finally submitted and corrected on the previous input pages using the „Back“ button at the bottom of the page. The customer can access, print and/or save the General Terms and Conditions from the ticket shop.
The ordering process can be canceled at any time by closing the browser window. The customer submits a binding offer to conclude a contract by submitting their ticket order online
to drehpunkt GmbH by clicking the „Complete purchase“ button. The contract is concluded in German. The contract is concluded when a ticket is sent
to the customer in accordance with VI. of these General Terms and Conditions, but at the latest when the service is provided by drehpunkt GmbH. These General Terms and Conditions are accessible to the customer on the order pages.
IV. Terms of payment, offsetting and rights of retention
The total price including VAT is due for payment immediately after conclusion of the contract. Payment for online tickets is made when ordering and can be made by credit card (VISA, MasterCard, American Express), PayPal, ELV or instant bank transfer
The customer is not entitled to any right of set-off or retention unless the counterclaim is undisputed or has been legally established. If the customer is an entrepreneur, the same applies to retention rights. If the customer is a consumer, they are also entitled to set off claims against drehpunkt GmbH if they assert claims arising from the same contract. They may only exercise a right of retention if their counterclaim arises from the same contract.
V. Exclusion of the right of withdrawal and cancellation
The customer cannot revoke their declaration of intent; the right of withdrawal is excluded according to Section 312g Paragraph 2 Sentence 1 No. 9 of the German Civil Code (BGB).
VI. Delivery of the online ticket (print@home)
After the contract has been concluded, the online ticket will be sent to the customer immediately in PDF format as an email attachment. The online ticket can be opened with a current PDF reader (e.g. Acrobat Reader) and printed out by the customer. The customer must ensure that the barcode printed on the online ticket is neither smudged nor damaged. In addition to the PDF, the customer will receive a passbook file with the same ticket, which
can be saved on a suitable mobile device (smartphone, tablet) with the appropriate software.
VII. Access to the event, customer obligations
Admission to the event is only possible with a valid ticket and within the time period printed on it. The customer must present the printed online ticket at the entrance control of the respective event. Upon request, the customer must identify themselves at the entrance control with a valid official photo ID or passport. When using a reduced-price ticket, the identification document must be presented without being asked. Alternatively, the customer can save the online ticket as a PDF file on a suitable mobile device (smartphone, tablet, netbook) and present the mobile device’s display, on which the online ticket must be clearly visible, at the entrance control. Access to the event is only possible upon presentation of the online ticket at the entrance control. Customers must carry their online ticket with them at all times on the event site and present it to staff upon request. The requirements of the hygiene concept must be observed. If they are ill with Covid-19 or exhibit symptoms of a
respiratory illness at the time of their planned visit, they may not enter the Freiburg Trade Fair Centre.
VIII. Refund in the Event of Event Cancellation
: If the kreativ freiburg event is cancelled, drehpunkt GmbH will notify the customer immediately. At the same time, drehpunkt GmbH will refund the purchase price of the admission ticket.
IX. Transfer of the Online Ticket to Third Parties:
Online tickets are personalized. Access authorization to trade fair events is not transferable to third parties. In particular, commercial transfer of access authorization is not permitted.
X. Warranty
Consumers are entitled to statutory warranty rights. Compensation for damages, even under the warranty, will only be paid within the scope of Section XI of these Terms and Conditions. If the customer is a business, tickets are deemed to have been approved by the customer if any incompleteness or inaccuracies in the ticket are not reported to drehpunkt GmbH in writing within three working days of delivery in the case of obvious incompleteness or inaccuracies, or otherwise within three working days of discovery of the incompleteness or inaccuracies.
XI. Liability
In the event of intent or gross negligence on the part of drehpunkt GmbH or its representatives or vicarious agents, drehpunkt GmbH shall be liable in accordance with statutory provisions; the same applies to culpable breaches of essential contractual obligations. Unless there is an intentional or grossly negligent breach of contract,
drehpunkt GmbH’s liability for damages is limited to foreseeable, typically occurring damages. Drehpunkt GmbH’s liability under the Product Liability Act, for warranties, and for culpable injury to life, limb, or health remains unaffected. Unless expressly stated otherwise above, drehpunkt GmbH’s liability is excluded.
XII. Entry and Residence Regulations
The offer by the kreativ freiburg organizers to purchase tickets online does not release the customer from the obligation to obtain timely and comprehensive information about the relevant entry regulations for the Federal Republic of Germany, in particular regarding the possible requirement for a visa. The organizers of caravan live assume no responsibility for any disadvantages that arise for the customer as a result of their failure to comply with the applicable entry and residence regulations.
XIII. Other provisions
drehpunkt GmbH is entitled to commission third parties to issue invoices and collect payments from the customer. The customer accepts the house rules of the operator of the respective exhibition/conference venue. These General Terms and Conditions apply exclusively. Any deviating, conflicting, or supplementary General Terms and Conditions of the customer that are not expressly recognized in writing by drehpunkt GmbH shall not apply. Should any parts of these General Terms and Conditions be or become invalid, this shall not affect the validity of the contract or the remaining General Terms and Conditions.
XIV. Choice of law, place of jurisdiction
German law applies. If the customer is a consumer and had their habitual residence in a country other than Germany at the time the online ticket was ordered, the application of mandatory consumer protection regulations of that country remains unaffected by the above choice of law. If the customer is a merchant within
the meaning of Section 1 (1) of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the courts of Freiburg shall have exclusive jurisdiction over all disputes arising from or in connection with the contractual relationship in question.
